All orders of Forever Barnwood, LLC, both products furnished by Forever Barnwood, LLC from inventory without alteration or modification by Forever Barnwood, LLC to accommodate Buyers orders, are subject to the following terms and conditions:

Orders

Orders are paid for at point of sale. It should be understood by all that wood products, by their nature, are subject to variations in texture, color and appearance. While Forever Barnwood, LLC does its best to create a product that is consistent with regard to texture, color and appearance, within each category, natural variations will occur. We believe that these natural variations are what add additional character to our products and your project. Generally samples provided to distributors and shown on our website are good representations of the product that will ship. We recommend that all buyers should personally handle a representative sample of product, prior to making an order. All orders are final. All of our dimensional lumber is kiln dried. This should minimize the amount of warping and twisting normally associated with wood products. Our beams and posts, depending on size, are not necessarily kiln dried and may experience some twisting, and warping normally associated with natural drying of wood products.

Payment Terms

Product is paid for in full at the time of sale. All sales are final.

Shipping

All shipping dates are approximate only and are subject to confirmation by Forever Barnwood, LLC at time the order is placed. Shipping is also subject to unavoidable delays caused by material shortages, strikes, accidents or other causes beyond Forever Barnwood, LLC control.

Lead Times

Normal lead times are 1-2 weeks or longer depending on products ordered. Lead Times for some custom manufactured products may be longer.

Shipping & Delivery (All Products)

Forever Barnwood will package your order according to its contents, method of freight and distance of travel to ensure that it arrives safely at your facility. If you have any special conditions regarding how you would like the order shipped or how it is delivered, please let us know as far in advance as possible and we will do our best to accommodate your needs.

Unloading at your location (Most Large Products and Large Quantities)

Upon delivery, the customer or customer’s representative will be responsible for unloading the order. It is advisable to have plenty of assistance and/or equipment available to help.

Returns

No return may be made of any product unless the product is defective. Product that has been installed, cut or altered in any way may not be returned. Custom Products cannot be returned unless the product is defective. If Product is deemed to be defective, Forever Barnwood reserves the right to replace the product.

Warranties

(a) All Products are sold “AS IS”. Forever Barnwood, LLC warrants that the Products are free of defects beyond that which provide the character necessary to the Product. Forever Barnwood, LLC also warrants that ours products are free of lead and formaldehyde

(b) THE WARRANTY PRINTED ABOVE IS THE ONLY WARRANTY MADE BY FOREVER BARNWOOD, LLC

AS TO ITS PRODUCTS, AND ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANT ABILITY AND FITNESS FOR A PARTICULAR PURPOSE ARE DISCLAIMED.

Limitation of Liability

It is understood and agreed that any liability of Forever Barnwood, LLC, whether in contract, in tort, under any warranty, in negligence or otherwise, shall not exceed the return of the amount of the purchase paid by Buyer and under no circumstances shall Forever Barnwood, LLC be liable for special, direct, indirect or consequential damages. Buyer acknowledges and agrees that the price quoted for Forever Barnwood, LLC Products is consideration in the limitation of Forever Barnwood, LLC liability. No action arising from the purchase of Forever Barnwood, LLC Products may be brought by Buyer more than one year after the shipment date of such Products.

Waiver

Forever Barnwood, LLC waiver of any of the terms and conditions of this Agreement shall not be construed as a waiver of any other term or condition.

Entire Agreement

These terms and conditions constitute the entire agreement between Forever Barnwood, LLC and Buyer and such terms and conditions shall not be modified or amended except by a writing executed after the date hereof. These terms and conditions shall supersede any provisions, terms and conditions contained in any purchase order or other writing Forever Barnwood, LLC may receive from Buyer, and the rights of the parties shall be governed exclusively by the terms and conditions hereof.

Designation of Law and Forum

In any action brought hereunder, the parties waive their right to a trial before a jury. The parties agree that the laws of the State of Wisconsin shall control in any dispute, and that such legal actions arising out of or related to the purchase and sale of Forever Barnwood, LLC Products shall be brought in Pierce County, Wisconsin.

At the time you receive your order, you must check for damages and/or missing items, and note that accordingly bill of lading. It’s a good idea to have a copy of your invoice with you, so you can verify you received all of the items ordered. If you do not check the materials yourself, please make certain that the person signing for them checks for damaged or missing items. If no damages are noted on the bill of lading, Forever Barnwood, LLC cannot be held responsible for any damages or shortages that occur.
